Papir Card System

IMPORTANT LEGAL AGREEMENT: By accessing, registering for, or using Papir (papir.ca), you enter into a binding legal agreement with Papir Technologies. Your acceptance of these Terms is recorded permanently, including your IP address and timestamp, as required for legal proof of consent under GDPR Article 7. If you do not agree, you must not use our service.
1. Acceptance of Terms LEGAL CONSENT
By accessing, registering, or using our platform, you confirm that:
- You are at least 18 years old or have verifiable parental consent
- You have read, understood, and agree to be bound by these Terms
- You agree to our Privacy Policy which is incorporated by reference
- Your acceptance is legally binding and will be recorded (IP address, timestamp, and consent check)
- If you are accepting on behalf of a company, you represent that you have authority to bind that entity
2. Description of Service
Papir is a web-based platform that allows users to create, manage, and share augmented reality cards with embedded media (images, videos, audio, text) through QR codes. The service includes:
- Card creation and customization tools
- Media upload and storage
- QR code generation
- Public viewer for scanned cards
- Analytics for card creators
3. Eligibility and Registration
3.1 Age Requirements
- General: You must be at least 13 years old to use the Service
- European Users (GDPR): You must be at least 16 years old or have parental consent
- If you are under the applicable age: Do not use the Service. We will delete any accounts discovered to be underage
3.2 Registration
To access certain features, you must register an account with accurate and complete information. You agree to keep this information updated.
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at security@papir.ca of any unauthorized use.
4. User Content and Intellectual Property
4.1 Ownership
You retain all ownership rights to the media, text, and content you upload to Papir. We claim no ownership over your content.
4.2 License Grant to Papir
By uploading content, you grant Papir a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Store, process, and display your content solely for the purpose of providing the Service
- Create backups for disaster recovery (deleted after 30 days)
- Allow others to view your content when they scan your QR code
This license continues until you delete your content or account, except where we need to retain copies for legal compliance (e.g., activation records).
4.3 License Grant to Other Users
By making your card public via QR code, you grant other users a limited, non-exclusive license to view your content through the Service.
4.4 Content Restrictions and Prohibited Content ABUSE REPORTING
You agree not to upload, share, or distribute content that:
- Illegal: Violates any applicable law or regulation
- Harmful: Promotes violence, self-harm, or illegal activities
- Harassing: Contains hate speech, harassment, or threats
- Explicit: Contains pornography or sexually explicit material (non-educational)
- Infringing: Violates intellectual property rights, copyrights, or trademarks
- Malicious: Contains malware, viruses, or harmful code
- Private: Contains personal information of others without their consent
- Deceptive: Impersonates others or makes false representations
4.5 Content Moderation and Enforcement
We reserve the right, but not the obligation, to:
- Review content for compliance with these Terms
- Remove or disable access to any content that violates these Terms
- Suspend or terminate accounts of repeat infringers
- Report illegal content to law enforcement authorities

6. Prohibited Activities
You agree not to engage in any of the following:
- Abuse: Using the Service for spam, bulk messaging, or harassment
- Reverse Engineering: Decompiling, disassembling, or hacking our systems
- Automation: Creating automated scripts, bots, or scrapers to access the Service
- Impersonation: Pretending to be someone else or misrepresenting affiliations
- Interference: Disrupting the Service's operation, security, or performance
- Unauthorized Access: Attempting to access accounts, systems, or data you don't own
- Resource Abuse: Uploading excessively large files or overwhelming our infrastructure
- Commercial Use: Using the Service for commercial purposes without permission (except personal card creation)
7. Service Modifications, Availability, and Pricing
7.1 Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you for any such modifications.
7.2 Availability
We strive for high availability but do not guarantee uninterrupted, error-free, or secure operation. We may perform maintenance that causes temporary downtime.
7.3 Pricing Changes
- Free tier: May be modified or discontinued at any time
- Paid plans: Price changes will be communicated 30 days in advance
- Legacy pricing: Existing paid users may be grandfathered at their current rate
7.4 Storage Limits
We may impose reasonable limits on storage, file sizes, and bandwidth usage. Excessive usage may result in throttling or account review.
8. Payment, Refunds, and Subscriptions
8.1 Free Tier
Basic features are available free of charge with reasonable limitations on storage and usage.
8.2 Paid Plans
Premium features require payment. All fees are in USD and are non-refundable except as required by law or at our sole discretion.
8.3 Subscription Renewal
Paid subscriptions automatically renew until canceled. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
8.4 Refund Policy
- No refunds for partial months of service
- Refunds considered for technical issues preventing service use (contact support@papir.ca)
- EU users: Right to withdraw within 14 days under consumer protection laws
9. Intellectual Property Rights
Papir, our logos, designs, trademarks, platform code, and all related intellectual property are owned by Papir Technologies and protected by Canadian, US, and international copyright and trademark laws. You may not use our intellectual property without express written permission.
10. Third-Party Services
Our Service integrates with third-party providers (Supabase, Railway, Stripe, PayPal). Your interactions with these services are governed by their respective terms. We are not responsible for their actions or policies. See our Privacy Policy for details.
11. Disclaimer of Warranties AS-IS
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PAPIR TECHNOLOGIES DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT OF INTELLECTUAL PROPERTY
- UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION
- ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
- CONTENT DELETION OR LOSS
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPIR TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL
- DAMAGES EXCEEDING THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS
- DAMAGES ARISING FROM THIRD-PARTY CONDUCT OR CONTENT
Some jurisdictions do not allow these limitations, so they may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Papir Technologies, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your uploaded content
- Your violation of these Terms
- Your violation of any law or third-party rights
14. Termination
14.1 By You
You may terminate your account at any time through account settings or by emailing support@papir.ca.
14.2 By Us
We may terminate or suspend your access immediately, without notice, for:
- Violations of these Terms (especially prohibited content)
- Non-payment of fees
- Extended inactivity (24+ months)
- Legal or regulatory requirements
- At our discretion, with or without cause
14.3 Effect of Termination
Upon termination:
- Your access to the Service ends
- We may delete your content per our Privacy Policy retention schedule
- Activation records (IP, timestamp) are permanently retained for legal compliance
- Sections 9-20 survive termination
15. Changes to Terms
We may update these Terms at any time. Material changes will be communicated:
- Email notification at least 30 days before effective date
- Platform notification upon login
- Updated "Last Updated" date at the top of this page
Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service.
16. Governing Law and Dispute Resolution
16.1 Governing Law
These Terms are governed by the laws of Canada, without regard to its conflict of laws principles.
16.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved as follows:
- Informal Resolution: Contact us first at disputes@papir.ca to attempt informal resolution
- Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration in accordance with the Canadian Arbitration Association rules
- Location: Arbitration shall take place in Ottawa, Canada
- Class Action Waiver: You agree to resolve disputes on an individual basis, not as a class action
- Small Claims: Either party may bring claims in small claims court
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Papir Technologies regarding the Service and supersede all prior agreements.
19. Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
